Netflix wants users to be able to share viewing habits on Facebook, US Senate agrees

We knew Netflix was big, but big enough to change the law? Apparently so, as an amendment to the Video Privacy Protection Act backed by the streaming service has been cleared by the US Senate. If the alteration gets a final sign-off from Obama himself, it’ll allow Netflix users to easily share their streaming activity on Facebook — something already implemented in regions outside the US. The current law, which makes such sharing tricky, was passed in the late 80’s after a judge saw his video rental history leaked to a newspaper. There wasn’t anything embarrassing in this list, but the episode begat the Act which requires a person’s legal consent every time there’s a request to publish such data. Instead, Netflix is proposing a one-off authorization which streamlines the whole process. We imagine the president’s signature is just a formality, in which case you’ll soon know exactly how many times we’ve watched Step Up 2: The Streets.

Apple Forced to Run Public Apology in 14pt ArialHaving lost its appeal against the UK High Court of Justice’s ruling, which decided Samsung’s tablet designs didn’t infringe on the iPad, Apple is being forced to make a public apology.

The best bit? The judge in question has described how it has to do it. Apple will have to post notices on its website, and in newspapers, explaining why it’s sorry. In Arial. With a font size no smaller than 14 pts. Brilliant.

The case in question had previously thrown out Apple’s complaints, when Judge Colin Birss explained that the Galaxy tablets “do not have the same understated and extreme simplicity which is possessed by the Apple design… They are not as cool.” As a result, Biriss judged that consumers were unlikely to confuse the two tablets, meaning that Samsung’s product didn’t infringe on Apple’s registered design. UK judge rules HTC doesn't violate apple's patentsWell, Apple had a few legal victories over the last couple of weeks, but it’s just been handed a significant defeat by Judge Christopher Floyd. The UK court handed down a ruling that HTC does not violate four Apple patents, including the infamous slide-to-unlock claim. What’s more, the judge ruled that three of the four patents in question were not valid, among them the aforementioned unlocking design. The only one of the four patents that stood at the end of the day was related to scrolling through images in the photo management app, but HTC did not infringe upon the claim. This follows the ITC refusing an emergency ban on HTC products in the US. Don’t think you’ve heard the last of slide-to-unlock, however. As HTC, Apple and Samsung have repeatedly shown, they’re just as interested in competing in the court room as they are on store shelves (if not more so).

Walmart Is Using Twitter To Find Out About New Products

Walmart-sign-blue-outside-retailWalmart’s (WMT) new effort to again change the retail industry has encountered early success.

The retail giant is the first chain to use social media to create an American Idol-style competition for new products, and its “Get on the Shelf” Contest has attracted 274,000 votes in four days after kicking off on March 7.

No, there won’t be a panel with a condescending British judge criticizing product presentations.

Instead, Walmart promotes the work of companies and entrepreneurs in the U.S. and its territories by uploading their self-made product videos that feature everything from home appliances to apparel to beauty products on this contest website. Contest hopefuls need to fight their way into the top 10 by April 3 to qualify for the second round, which will last from April 11 to April 24.

From that point, one lucky winner will get his or her product promoted at selected Walmart stores across the country along with being featured on the homepage of Walmart.com. Two other first place winners will also win space on the store’s website.

Walmart sees the potential for social media to revolutionize the retail industry as principal Engineer Guhu Jayachandran at @WalmartLabs, the social media branch of Walmart, in Silicon Valley created the concept. Co-head of @WalmartLabs and Senior Vice President of Walmart Global e-Commerce Venky Harinarayan says they want to locate “undiscovered products that have not yet reached our shelves.” He also stated, “For a long time, the ability to get a product into a retail store was at the sole discretion of the store buyer. Today, we are removing these barriers by giving anyone a chance to launch their product at Walmart and reach millions of shoppers at Walmart nationwide.”

So far, there has been no response from its rivals like Target (TGT) and Sears ( SHLD), but they will most likely imitate the store if this contest continues to catch the public’s attention and turns into a hit. On average, the products receive 55,000 daily votes and the website receives 92,000 daily page visits.

So, tell all your friends and start cheering for your favorite contestants outside of Walmart stores.

Encrypting Your Hard Drive No Longer Works Against Federal ProsecutionSometimes common “street smarts” fail you. Like when you ask the guy who’s selling you drugs if he’s a cop. Or when you encrypt your hard drive and refuse to unlock it for prosecutors while citing the self-incriminating clause of the Fifth Amendment.

A federal court judge has just ruled that being forced to decrypt one’s hard drive during prosecution does not violate the defendants’s Fifth Amendment rights. The ruling stems from a case against Ramona Fricosu, who is charged with mortgage fraud. She has refused to decrypt the contents of her hard drive arguing that doing so would require her to essentially testify against herself.

Nuh-uh, said judge Robert Blackburn, citing an earlier ruling against one Sebastien Boucher. In that case, the courts decided that, while Boucher’s encryption password was certainly protected, the information on his drive could be considered evidence in the case and was therefore not subject to the same liberties.

“I find and conclude that the Fifth Amendment is not implicated by requiring production of the unencrypted contents of the Toshiba Satellite M305 laptop computer,” Blackburn wrote in his opinion today. He also cited the All Writs Act, a 1789 statute, could be invoked as well to force Fricosu’s compliance.

Friscosu has until February 21 to comply or face contempt of court charges. Geez, it’s getting to the point that your secrets are better left on microfilm in pumpkin patches rather than on your hard drive. [CNet via The Verge]
