Disney considering 28-day rental window, because ‘On Stranger Tides’ was that good

That sound you can hear is the studios dashing around as they look for a new scapegoat. Disney’s got Redbox and Netflix in its sights as it declares plans to impose a 28-day window before it’ll make its titles available for rental. Despite conceding that the studio hadn’t seen any impact on overall DVD sales, CEO Bob Iger pointed to a 16 percent drop in quarterly revenue compared to 2010 as the motivation. It’s also collecting splinters in its backside as it watches to see how well digital locker service UltraViolet fares with consumers before committing to join the program. Of course, given the legitimacy of First Sale Doctrine, it’s possible Redbox will do as its done with Warner titles and just buy ‘em at retail — as long as it can cover its costs as it does so.

I don’t live in a high risk area for deadly tremors, but after watching this earthquake-proof table easily survive having a 2,200 pound block dropped on it, I think I still want one for my office—just in case.

The table was designed by Ido Bruno and Arthur Brutter primarily for use in schools. Students are typically taught to hide under their desks in the event of an earthquake, but most desks aren’t designed to support the weight of all the debris were the building to collapse. Which is clearly demonstrated in this video when they drop just a 1,000 pound weight on a traditional desk and it’s immediately pancaked.

Watch This Earthquake-Proof Desk Easily Shrug Off a 2,000 Pound BlockIn addition to providing a safe haven for students, the desk’s supporting structure is designed in such a way that it also provides several escape routes depending on how debris has fallen. It’s also light enough to be lifted by just two students, and is built with durable but inexpensive materials so it’s actually affordable for a school to purchase en masse. Now it’s not available just yet, but based on these tests being conducted at the Structural Engineering department at Padua University in Italy, it shouldn’t have much trouble getting approved for sale. Sell Your Book in the iBookstore and Apple Won't Let You Sell It Anywhere ElseSelling a book with Apple’s iBook Author program is now a one-way ticket to Apple being the only place you can sell the book. Maybe selling your book on iBooks isn’t such a great deal after all.

Dan Wineman of Venomous Porridge went to publish his first book from within the iBooks Author application when he was met with a curious notice. Once a book is made available for sale in the iBookstore, it can only be sold through that venue.

A quick look at the iBooks Author EULA reconfirms the dialog box’s diabolical message:

(ii) if your Work is provided for a fee (including as part of any subscription-based product or service), you may only distribute the Work through Apple and such distribution is subject to the following limitations and conditions: (a) you will be required to enter into a separate written agreement with Apple (or an Apple affiliate or subsidiary) before any commercial distribution of your Work may take place; and (b) Apple may determine for any reason and in its sole discretion not to select your Work for distribution.

Ugh, the worst part is that you never agree to anything when you install the application. The EULA never appears when you install. Apparently, you implicitly agree to the EULA simply by using the software. If you’ve worked for weeks on a book only to discover you can’t sell it anywhere else once you publish it to the iBookstore, you’re gonna be pissed.

Apple is jumping into the world of publishing here. If you had a deal with Random House to sell your book, you wouldn’t be able to have Penguin Publishing also sell it. These deals, however, are transparent. The restrictions don’t just appear as you prepare to submit your manuscript. Apple is assuming rights over your content in the worst possible way. The Owner Of Flash Sales Site Rue La La Is Laying Off A Big Chunk Of Its Staff

UPDATE: Rue La La has reached out to us to update the story with some additional information.

Rue La La just laid off 11 percent of its 500-person staff, according to the company.

The Boston Business Journal first reported the layoffs.

Site owner Retail Convergence is also shutting down SmartBargains.com, a discount shopping site, according to the report.

Some employees were offered other positions in the company, and everyone was offered some kind of severance package, a source close to the company told us.

“It was a mess upstairs. People were crying all over the place,” one unnamed employee told the Boston Business Journal. 

Rue La La operator Retail Convergence raised about $25 million from General Catalyst Partners and Breakaway Partners before being acquired by a company called GSI Commerce for $350 million, reports The Boston Business Journal.

eBay then bought GSI Commerce in 2009, and Rue La La got $500 million in debt and equity financing as part of the deal, according to the report. Retail Convergence, the owner of Rue La La and SmartBargains.com was spun out as part of that deal.

Since launching in 2008, Rue La La has transformed online shopping and has become a leader in the “private sale” shopping space.  In a continued effort to revolutionize off-price shopping, we have made the strategic decision to double down on our core business.  This heightened focus on our core includes the restructuring of our Rue Local business by outsourcing our sales force and consolidating SmartBargains.com into Rue La La. SmartBargains.com was originally launched 1999.  These moves unfortunately resulted in the elimination of some staff positions.  Rue La La has continued to see dramatic growth with nearly $300MM in sales in 2011 and similar growth planned for 2012 and beyond.

Barnes & Noble looks to sell publishing arm, keeps the other to hold a Nook Tablet

In a sign of ever shifting priorities in the ole book business, Nook’s papa is reportedly looking to sell its publishing unit, Sterling Publishing. According to the Wall Street Journal, B&N acquired Sterling in 2003, ramping up its publishing efforts after more than 30 years in the business. News of a possible sale follows last month’s Q2 earnings report that saw a $6.6 million net loss for the bookseller. That same quarter, the company’s Nook business took an 85 percent leap forward, landing it a $220 million value. Barnes & Noble has yet to comment.

iPad maintains tablet dominance, HP’s TouchPad fire sale burned brightly

While the Android tablets continue to roll in, Apple can still lay claim to the lion’s share of the tablet market according to IDC’s latest report. Its research suggests that the iPad holds onto 61.5 percent of the worldwide market share, down from 63.3 percent last quarter. Android devices in total also saw a slight contraction, down from 33.2 percent to 32.4 percent. This is partly explained by the HP TouchPad’s final hurrah, which rocketed the ill-fated webOS tablet up to third place with a 5 percent of share of tablet sales and an estimated 903,354 devices sold. Samsung maintained its Honeycomb tablet crown, nabbing 5.6 percent of all tablet sales. The Korean manufacturer was closely tailed by Barnes and Noble’s Nook Color with 4.5 percent and Asus, arriving at fifth place with a four percent share. Tablets in total sold less than the analysts had predicted, although growth has still exploded 264 percent compared to this time last year. Meanwhile, E-readers outperformed estimates, with 6.5 million E-readers sold in the third quarter, up 165.9 percent from last year. Nissan sells more than 20,000 Leafs in first year; Fiat, Not So Much

Excerpt: Only a few months after announcing that it sold 10,000 all-electric Leaf cars in international markets, Nissan stated at the Tokyo Motor Show today that the company has sold over 20,000 Leafs since the car went on sale in December of 2010. The company also added that it expects to sell more than 10,000 Leafs in the U.S. by the end of 2011.
