Infuriating RIAA Knew That SOPA and PIPA Were Useless All AlongTorrentFreak has posted a supposedly leaked presentation by the RIAA’s chief lawyer that says that it defended SOPA and PIPA even though it knew the censorship legislation wouldn’t be effective against music piracy. Is the RIAA for real or are they just covering their asses, and what does it mean for your freedom going forward?

Massive Internet protests forced the RIAA’s puppets in Washington to back down from SOPA and PIPA, delivering a major blow the the RIAA’s crusade against Internet freedom. The leaked presentation called “U.S. Copyright Alert System and Other Voluntary Initiatives” was given in April to industry bigwigs, and it finds RIAA Deputy General Counsel Victoria Sheckler backpeddling from the organization’s legislative attacks on piracy. Just look at this slide. How pathetic:

In other words, the presentation all but admits what opponents of SOPA and PIPA knew all along; that the legislation would be useless. Now remember, this legislation jeopardized free speech on the Internet. If this is posturing, it’s an infuriating stance. It’s inconceivable that the RIAA would support legislation that so blatantly threatened your rights for nothing, but it’s the unfortunate truth

Since legislating censorship didn’t work, the RIAA has pivoted back to the Copyright Alert System, an anti-privacy initiative it’s been pursuing with ISPs. The new initiative was finally agreed upon last summer after years of debate. It was supposed to launch this month, but it’s been indefinitely delayed because all of the stakeholders—you aren’t one of them, by the way—can’t agree on how to implement it. Under the system, Internet users would be governed by a six strike system. The RIAA (or MPAA) would submit complaints of infringement to ISPs on behalf of copyright holders, after which the ISPs follow up with users using what’s called “graduated response.” In short, infringers are warned and warned again before anyone launches any significant legal action. The emphasis, the RIAA says, is on education. Bullshit.

You should be just as worried about this ISP monitoring as you were about SOPA and PIPA. Instead of bullying the government into restricting your freedom, the RIAA is bullying the ISPs into creating an Internet nanny state to intimidate you into compliance with whatever it wants. As the RIAA points out in the slide above, the only thing legislation would have have accomplished is increased policing by ISPs. With the Copyright Alert System it’s happening anyway. It’s unprecedented. And for what? There’s no evidence it’ll work. The RIAA says it will, but after this leak do you really want to take its word for it? [TorrentFreak via ITWorld via Slashdot]

RIM continued its downward slide yesterday. In the quarter ended May 31, it shipped shipped only 7.8 million smartphones, which was the same amount they shipped in the second quarter of 2009 three years ago. Global smartphone shipments have tripled over this same period.

Its market share, meanwhile, has slid from a high of 21 percent in 2009 to 7 percent in the first quarter. We don’t know what its market share will be in the second quarter yet, but given the huge slide in shipments we would expect it to drop farther.    

Compounding its woes, Blackberry delayed the release of its latest smartphone platform until 2013. A sale or breakup of RIM seems inevitable at this point. While RIM is undeniably maimed, the sale of a company shipping 40 million smartphones per year will have a significant impact on the mobile industry.

This Chart Shows Why Best Buy Should Be Particularly Terrified Of ‘Showrooming’ (BBY)

Brick-and-mortar retailers are scared of being reduced to a “showroom” where shoppers go to try items out before going online to make the final purchase. Some feel that the showrooming panic is totally overblown, but there’s one segment of retailers that’s particularly affected.

Consumer electronics retailers are experiencing more showrooming than any other category by far.

More than 6-in-10 customers who have used showrooming bought an item online in that category, according to a slide from comScore’s “State of the Internet in Q1 2012” presentation by senior director Tiffany Walker. No other product category came anywhere close to that number.

As the biggest consumer electronics big box store out there, Best Buy needs to do something about this fast.

Acting CEO Mike Mikan said as much at his company’s recent annual meeting. “[The customer’s] needs have changed,” he said. “We, unfortunately, have not.”

Internet Trends report finds online growth driven by China and India, users increasingly mobile

You probably don’t need a 112 slide PowerPoint presentation from Mary Meeker and the venture capital firm KPCB to tell you this, but the Internet, she’s getting bigger. Every year more and more people sign on and, not surprisingly, many of the 663 million netizens added over the last three years have come from developing nations like China and India. In fact, since 2008, China has accounted for almost a third of new web users, adding 215 million to the connected population. What also shouldn’t come as a shock, is that the boon in connectivity is also being pushed by the broader availability of 3G data connections. Areas like India, China and Vietnam have all seen triple digit percentage growths in 3G penetration since last year. Wireless broadband has really exploded in India, where year over year growth in subscribers was 841 percent, though, that still only equates to a four percent penetration rate. A Leak From The USA TODAY Shows How The Kindle Fire Is Blowing Away Other Android Tablets (AMZN, APPL)

Here’s an interesting look at how the platform wars are playing out across smartphones and tablets.

GeekWire landed an internal slide from USA Today that lists how many times its application has been downloaded. USA Today has a wider, more geographically diverse readership than most other newspapers, giving us insights into the ecosystem that we might not get from the typical measurement companies.

If USA Today’s internal statistics are any indication, the Kindle Fire is blowing other Android tablets out of the water. The slide shows 260,000 downloads of its app for Kindle Fire compared with only 130,000 for other Android tablets. That’s a two-to-one ratio.

The Kindle Fire still trails the iPad by some ~2.6 million downloads, but that’s unsurprising. What’s more impressive is how much headway the Kindle Fire has made in the short time since its release.

Further, you can see that the iPhone app is still beating the Android app in downloads. And Windows Phone has a lot of work to do.
